Sen. Lindsey Graham Bullies Sotomayor - While Accusing Her Of Being Bully

In the most aggressive questioning of Judge Sonia Sotomayor's confirmation hearing thus far, Sen. Lindsey Graham (R-SC) read out a laundry list of complaints about the nominee this afternoon. Graham went through insult after insult from anonymous reviews about Sotomayor's temperament, including ones that called her "nasty," "a terror," "a bit of a bull," and one that said she lacks any "judicial temperament." Graham then asked her directly: "Do you think you have a temperament problem?" (Watch the video below.)

In response to that last question, Sotomayor said, "No, sir, I can only talk about what I know about my relationships...when I ask lawyers tough questions, it's to give them an opportunity to explain their positions on both sides and to persuade me that they're right."

Graham later said, "I never liked appearing in court before a judge I thought was a bully." Sotomayor repeated that she does ask hard questions, but she does it "evenly for both sides."

After voicing those complaints and telling Sotomayor that "maybe these hearings are a time for self-reflection" for her, Graham became a bit of a bully himself, asking her if she remembered her "wise Latina" quote. When the judge answered in the affirmative, he asked her to recite it - twice. Sotomayor hedged a response, and Graham plowed ahead, said, "I've got it here," and read the quote out himself.

The infantilizing questioning from Graham continued throughout his entire thread; he interrupted her answers multiple times, and made a theme out of asking her to explain her understanding of certain legal concepts and current events:

Do you know what the term 'legal realism' means? Can you explain it?

On 9/11, which New York City native Sotomayor described as "the most horrific experience of my personal life and the most horrific experience in imagining the pain of the families of victims of that tragedy":

Do you know anything about the group that planned this attack, who they are and what they believe? Have you read anything about them?

It's worth noting what Graham's Supreme Court confirmation questioning was like back in 2006, at the hearings for Samuel Alito. He took his allotted time as an opportunity to apologize to Mrs. Alito, who was upset by what was perceived to be overly tough questioning of her husband:


As for Sotomayor, Sen. Amy Klobuchar (D-MN) said at a press conference after the hearings that the nominee best showed her temperament today, in how she calmly answered Graham's "barrage of questions."

Versha, I have to tell you, if you think that was "grilling," then you need to get in front of more judges. Or go back and watch the tapes of what Republicans did to Anita Hill. Whoo-boy, that was a grilling.

She is a Supreme Court nominee. She's not running for student body president of Utica College. This is the last time she will face any questioning from anyone with authority. And if she can't handle the see-them-coming-from-way-down-8th-avenue questions Lindsay was throwing at her, then she doesn't deserve the job.

But she handled it magnificently, these questions we all knew was coming.

I agree with you completely. This is a lifetime position. If she isn't able to handle Graham, (which she is and did with the utmost grace and dignity), she certainly wouldn't be able to handle Scalia. Besides, the answers to these questions and how she phrased her responses were important to those who support her as well.

I only wish that the media would scrutinize Sarah Palin in this way. Supreme Court justice is one of a panel. POTUS is one and is the most powerful position in the world.

Excellent point. This is the last time she will ever face such a tough challenge. I like her, but it is easy to imagine that she is now - as Roberts and Alito before her - putting on the soft, friendly, angelic face just before those who now hold her immanent fate in their hands. Even if we want to see her confirmed and are sure she'll be a good justice, we shouldn't get all offended and hissy about some tough questioning.

Lindsey is just scoring points with the base with this nonsense. As for Judge Sotomayor, all she has to do is not lose her cool and she's in, just like Lindsey boy himself noted yesterday. It's all just theater.

I know that Mr. Graham must love the theme song from Live and Let Die, I find his repetition of the phrase "world in which we live in" extremely irritating, especially coming from a whiny hypocrite. If one precept of the American legal system is that individuals have the right to answer to their accusers, the use of anonymous quotes in challenging the character of Justice Sotomayor was surely a low point in today's hearing.

I love this exchange at the end:

Sotomayor: "And I would hope that we've come in America to the place where we can look at a statement that could be misunderstood and consider it in the context of the person's life, and the work they've done."

Sessions: "You know what, if that comes of this hearing, the hearing has been worth it all, that some people deserve a second chance when they misspeak and you would look at the entire life story to determine whether this is an aberration or just a reflection of your real soul."

I think they call that "agreeing to disagree". She's saying that it would be nice if we could stop beating someone over the head with our interpretation of their words, and he's saying he agrees -- as long as the person admits that they misspoke.

In other words -- ain't gonna happen.

Lindsay Graham (o great buddy of John McCain and Joseph Lieberman) defines the concept of sanctimonious. Mr. JAG is so self-absorbed that he doesn't realize when he's making an ass of himself, which is generally any time he opens up his "thoughtful" mouth. He's now trying to redeem himself with Glenn Beck and Rush Limbaugh by typically inane bullying and embarrassing self-righteousness. That Scalia is quite a pussycat. Graham is worried that Sotomayor might hurt his feelings if she ends up on the court.

Not correct in this instance. The Thugs are trying to find inn string of words a way to prove a point, that she would judge in a certain way, despite having THE PROOF, thousands of pages of her judging, and being uanble to find any evidence that she does what they are hoping to scare the American people with. It is shamelss, a lie, dishonest, and merely thievery, an attempt to steal the Soup Ct seat, and not done by Democrats.
And she should turn on him, and say Senator, DID YOU READ MY decisions? If not, let's move on until you know what you are talking about". If yes, "Well, then find in one dedison where that occurred, and let's deal with it, and if noy let's put it in the abominable snowman, chubacabra file".

Graham must hate women and holds a double standard. He quotes an anonymous source questioning Sotomayer’s temperament. When will anonymous sources ever be allowed in a court of law but I guess in this process its perfectly ok. Graham neglected to site the 100’s of lawyers who raved about her temperament and legal prowess

Lindsey Graham is a scumbag. I'm waiting for the shoe to drop and we find out he is doing the "wide leg spread mambo" in some airport bathroom or hiking the appalachian trail.

What a freaking joke that guy is. Normally I try to respect differing opinions, but idiots like Graham are exactly why the GOP is in the shape it is in.

I'm pretty sure Graham (a 52 year old bachelor) hates women --and himself for being gay.
