Sen. Joe Lieberman (I-CT), chair of the homeland security committee, released a statement today urging Attorney General Eric Holder and the administration to "reconsider" plans to bring five alleged conspirators in the Sept. 11, 2001, attacks to New York City to stand trial. Here is the full statement:
Senator Joe Lieberman (ID-CT) today strongly differed with Attorney General Eric Holder's decision to prosecute the individuals charged with committing the terrorist attacks of September 11, 2001 in civilian courts in the United States.
Senator Lieberman said, "The terrorists who planned, participated in, and aided the September 11, 2001 attacks are war criminals, not common criminals. Not only are these individuals not common criminals but war criminals, they are also not American citizens entitled to all the constitutional rights American citizens have in our federal courts. The individuals accused of committing these heinous, cowardly acts of intentionally targeting unsuspecting, defenseless civilians should therefore be tried by military commission rather than in civilian courts in the United States."
Senator Lieberman continued, "The military commission system recently signed into law by the President as part of the National Defense Authorization Act provides standards of due process and fairness that fully comply with the requirements established by the Supreme Court and the Geneva Conventions. Earlier this year, when passing the National Defense Authorization Act, the Senate also passed language expressing its clear intent that military commissions rather than civilian courts in the U.S. are the appropriate forum for the trial of these alleged terrorists. I share the views of more than 140 family members of the victims of the September 11, 2001 terrorist attacks who recently wrote to the Senate urging that the individuals charged with responsibility for those attacks should be tried by military commission rather than in civilian courts in the United States: It is inconceivable that we would bring these alleged terrorists back to New York for trial, to the scene of the carnage they created eight years ago, and give them a platform to mock the suffering of their victims and the victims' families, and rally their followers to continue waging jihad against America."
Senator Lieberman urged the Administration to reconsider its decision and to try those charged with responsibility for the September 11, 2001 attacks using the military commission system that was created by Congress and recently signed into law by the President for that very purpose.

Joe, Joe, Joe. Listen to you ... "they are also not American citizens entitled to all the constitutional rights American citizens have in our federal courts." Sigh.
Sorry to get all lawyerly on you, Joe, but I'm afraid that's not how those particular rights work.
You see, Joe, some constitutional rights (say, the right to vote) are Citizen Rights ... you have to be an American to get them. Other Constitutional rights are Person Rights; they apply to everyone, American or not. On the Person Rights list is most of the liberties in the Bill of Rights, including essentially all of the protections for criminal defendants embodied in the Fourth, Fifth, and Sixth, and Fourteenth amendments. Everybody charged with a crime gets the right to counsel, to trial by jury, to procedural and substantive due process -- the whole lot.
For instance, you might want to look at the 14th Amendment, which declares "... nor shall the State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws. Or the Sixth Amendment, which applies "[i]n all criminal prosecutions", not just the ones where the Defendant's an American.
Joe, it must be embarrassing for a four-term senator to make this sort of blunder, but don't feel too bad. The guy who should really be embarrassed was a Con Law professor at Yale Law School in the mid-sixties. Didn't they teach you this stuff? Con Law's on the bar, after all, and there's always the slim chance that some student or another might end up in some sort of job where a working knowledge of the Constitution might come in handy.

Oh, he's not embarrassed. This is a man who coined the phrase Joementum. He's so reliably right-wing on national security issues.
Obama's proper response: "Joe, when you get to be president, you can make decisions about how to prosecute terrorists. Until then, keep your trap shut."
Of course, Obama is the cool and calm leader and he's probably say something like, "reasonable people can disagree," or whatever. But, Lieberman needs to be humbled by someone. Maybe some moderate republic (as if) could do the job.

I'm not sure what he means by "inconceivable". I can certainly conceive of it; in fact, the guys who tried to bring down the WTC in 1998 were tried in NYC. Unwise, maybe, but inconceivable? Hardly.

Trials in the American Courts for those who we believe are responsible for killing thousands of Americans. American justice is something that we should be proud to apply to anyone we are willing to place in jeopardy of loosing their life. If we can not be confident in our courts in the most difficult cases how can we proclaim that other countries, Iraq to mention only one, should establish democracies with independent judicial systems?
I for one applaud this courageous move by the Justice Department. I think they have lived up to their name today.
