On Monday night, the Daily Show argued that a civilian trial in New York City for self-proclaimed 9/11 mastermind Khalid Sheikh Mohammed is a bad idea -- not necessarily for some of the reasons offered by conservatives -- but because the media will definitely go way overboard.

Okay here's what the Democrats do. Change their views 180 degrees, against health care reform, against taxes for the rich, all of it.
Then, when the Republicans all come out in opposition to whatever the Democrats want, carping that we NEED health care reform and so on,just out of pure contrarianism as Guiliani displays so well here, then the Democrats suddenly say "Okay, we agree" and quickly pass health care reform and all the rest
Just have to know how to play the game, that's all.

Sadly, it would probably work - even though the last time I saw somebody use that trick, it was in a Bugs Bunny cartoon.
I mean, it's already worked for Medicare - the Republicans spent most of the 90s trying to dismantle the program, and now they're suddenly opposed to any changes.

Yeah in reality it wouldn't work because though Guiliani spun to the opposite position after two years, a lot of Republicans do it far more quickly, sometimes even in the same sentence, as displayed in the "Keep government out of Medicare!" signs carried by Dick's Armey of teabaggers.
It's like a neutron star, flipping from one side to the other so fast that if you tried to time it you'd probably get it wrong. Ah well.
It's not the first time that I wished life were more like a Bugs Bunny cartoon.

Unfortunately the Republicans would always win that game.
It is just to easy to reverse direction on government policy when the only real policy you have is to take control of government and milk it dry with corruption, useless wars and mismanagement.
You just can't make such rapid reversals when you actually hold positions in which you believe something.

I think you put your finger on the essence of the problem.
In fact, the Democrats could never do that.
In a game of finesse, or chicken, the Democrats will always blink first.
Why?
It's the old saying: "The person that cares the least, controls the relationship."
Republican's don't give a flip - about anything. Democrats, thus, can never win in a game of finesse with the Repubicans because at the end of the day, the Democrats always care more about America and the people who make up America, Americans, than the Republicans will ever care.
You want to win a game of Finesse? Hold rich people hostage. But then they are still people, and people with dollars at that, so Democrats can't do that either.
There's only one way for Democrats to win - and that is massive majorities in every legislature and constitutional rules minimizing the role of money (keeping it under the table where it belongs).

Remember, Republicans can simultaneously beat their chests and talk about what manly men they all are -- how they love to strut around on aircraft carrier decks in fake flight suits and giant codpieces -- while being absolute babies when it comes to discussing actual terrorists and whether they are or aren't capable of passing through solid prison walls and destroying NYC with their radioactive fire breath.
It's called being a ruthless tribalist. Remember that people in cults can simultaneously claim to be favored by the Soul of the Universe *and* constantly under assault from the infidels and unclean.
It's just too bad that the media is such a worthless corporate enabler that these people get to control the news cycle most of the time.

This does become a legitimate concern. It will be too much of a temptation for MSM not to go nuts over a KSM trial.
And in doing so, repeating many if not all of the GOP's talking points. Thereby doing their best to frighten everyone willing to listen, especially the under-informed.
It's going to get uglier than the @#$%^& on trial.
