
In their quest to cast President Obama's handling of the Christmas bomber as weak and ineffectual, Republicans have had to overcome a stubborn fact: The Bush administration handled shoe bomber Richard Reid in similar fashion in 2001. So what do you do with stubborn facts? You change them.
On the Daily Show last night, Newt Gingrich claimed the "shoe bomber," Richard Reid, is an American citizen.
Reid is actually a British citizen.
Gingrich was attacking the Obama administration for reading the Miranda rights to the Christmas Day attempted bomber, Umar Farouk Abdulmutallab. Jon Stewart pointed out that the Bush administration did the same to Reid.
But Gingrich defended President Bush's decision by falsely claiming Reid was an American citizen, unlike Abdulmutallab.

At the end of the show (and after the interview), Stewart pointed out that Gingrich had been wrong about Reid's citizenship.
Late update: Gingrich admitted he was wrong today via Twitter:
On daily show was wrong re: ShoeBomber citizenship, was thinking of Padilla. Treating terrorists like criminals wrong no matter who is Pres.
Jose Padilla was a U.S. citizen held as an enemy combatant and accused of helping build a "dirty bomb." He was eventually convicted in civilian court on charges of supporting and funding terrorism.
Later update: The White House attacked Gingrich for this today in the official White House blog.

If you watch his explanation at the end of the show, he explained that the fact he was an American citizen "didn't sound right." He can't be expected to be able to refute any ridiculous lie on the spot because it's not like Reid's citizenship has ever been an issue. He decided to instead let it go, check the facts before taping the end segment of the show, and correcting it then. Smart move, because had he disagreed and been wrong, the right would've exploded on him for it.

The only way so-called republicans can back up their policies is to lie. Whether it is WMD that do not exist, tax cuts that do not pay for themselves, death panels that don't exist, or freak snow storms that are predicted by climate change science somehow proving climate change is not real, they can only rely on misinformation. Left to debate the issues on the facts they are lost. Someday a real journalist may call them on this. Until then we can only hope comedians like Stewart catch the BS.

Everyone who thinks the rights granted in the constitution are granted only to U.S. citizens should have to go back to school and take an intensive civics class. That is the fact that Stewart should have rammed down the Newt's throat. It doesn't make any difference whether Richard Reid was a citizen or not - if he was arrested in the U.S., the rights granted in the constitution are applicable to him as well as Abdulmutallab.

There are so many things wrong w/Gingrich's points. Reid is a British citizen; the saboteurs of WWII fame were German soldiers, in civilian clothes, which equates to bona fide war crimes under the Geneva Convention; at the time they were picked up, we were in a declared war against Germany, Japan and Italy. Almost all of the convictions of terrorists came through US civilian courts, under US Law; those that have been convicted are serving terms that are or equate to life. Not one of the prisoners has escaped, it is doubtful they ever would/could. Gingrich was so incredibly wrong, I am surprised he had the guts to lie so blatantly and show no shame about doing so.
Kudos to Stewart...I too would love to see NYer's take this one and show the world we are a nation of law and will not be cowed by a bunch of fanatical miscreants. I was born a NYer, and grew up there, and while I live in NE now, I know the people of NY...and we are a good people that can handle anything. The resilience of the American people is the heart and soul of this nation, and fear-mongers like Gingrich are little more than cowards.

Also citizenship is a red herring. According to the Constitution ALL MEN are created equal. It does not say ONLY ALL AMERICAN CITIZENS are created equal, and therefore every other nation's citizens are not created equal.

I once saw a basketball player get a defensive rebound, and quickly go up and shoot the ball into his own basket(scoring for the opposition). For a moment it didn't register with me: did he just do what I saw him do? Maybe Stewart had a similar moment?
I think Newt is honest enough(?) to say whether he really thought Reid was an American, or just forgot he was a Brit in the heat of rhetorical battle. Was he ill-informed or just sputtering nonsense?

Republicans benefit greatly from fueling fear in the American populace. It has become easy. Fear with violence is all over our media. It works well. We are proof.
The "big lie" with "be afraid" are the two guns in their holster.
But the terrorism we experienced is a crime and be treated as a crime. Making it a war profits the demagogue and their friends. It is succeeding well.
After sinking hundreds of American ships off the gulf and Atlantic coasts by a German enemy who declared war on us, the treatment of German sailors was nowhere near what Gingrich was, in his "big lie" way, equating with Guantanamo.

In the interest of clarifying this subject.
Yick Wo v. Hopkins 1886
"The rights of the petitioners, as affected by the proceedings of which they complain, are not less because they are aliens and subjects of the emperor of China. . . . The fourteenth amendment to the constitution is not confined to the protection of citizens. It says: "Nor shall any state deprive any person of life, liberty, or property without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws." These provisions are universal in their application, to all persons within the territorial jurisdiction, without regard to any differences of race, of color, or of nationality; and the equal protection of the laws is a pledge of the protection of equal laws. . . . The questions we have to consider and decide in these cases, therefore, are to be treated as involving the rights of every citizen of the United States equally with those of the strangers and aliens who now invoke the jurisdiction of the court."
This is due to the very wording of the 14th amendment. This is the first bit of established case law on the subject and it has been reenforced with every subsequent decision. It the law plain and simple. This is the correct response to anyone who cries out about giving terrorist rights. If Americans are unhappy with this they must change the Constitution. Even the Bush administration understood this.

we need not change the law. since they have declared war on us we could name them as enemy combatants and hold them for as long as the war goes on. without trial, as is being done to many others right now, both by bush and obama. see, the law is never as black and white as one thinks. always there are shades of gray. if we declared war on them, something we should have done, then we could hold them as POW.
