
Rep. Pete Hoekstra (R-MI) fired back today at the assertion yesterday by John Brennan, President Obama's top counterterrorism adviser, that four Republicans didn't object when Brennan told them in December that suspected Flight 253 bomber Umar Farouk Abdulmutallab was being held in FBI custody.
Hoekstra didn't dispute Brennan's account that he was one of four Republicans who was briefed by Brennan shortly after Abdulmutallab's arrest. But Hoekstra maintained that they were only told that Abdulmutallab was in FBI custody.
"We weren't told that he was going to be read his Miranda rights," Hoekstra said.
Yesterday on Meet The Press Brennan said that when he briefed top Republicans on Christmas Day, none of them raised any objections to holding Abdulmutallab in FBI custody.
"They knew that 'in FBI custody' means that there's a process then you follow as far as Mirandizing and presenting him in front of a magistrate," said Brennan.
Today on Fox News, Hoekstra countered that he couldn't possibly have known that "in FBI custody" meant Abdulmutallab would be read his Miranda rights, since he is not an attorney and Brennan did not "get into any kind of details."
Referring to Brennan's comments yesterday, Hoekstra said: "He said 'they should have known, they understand what happens when I say that he's in custody,' and it's kind of like, no, all of those options were still open when we talked that night, but he didn't take us through that."
He continued: "I know he didn't take us through that because I'm not an attorney. If he had said, 'Congressman, we're going to put him through the civilian courts, we're going to Mirandize him,'" then "I would have called my attorneys on the intel committee and other attorneys and said, 'Hey, what are our options, what's the best way to move forward?' We never had the discussion that he outlined."
When asked if he had actually objected to the possibility of Abdulmutallab being read his Miranda rights, Hoekstra finished strong: "We weren't told that he was going to be read his Miranda rights! The comment was, 'He's in custody,' and its kinda like, 'Well thanks, John. I knew that.'"

Hoekstra is running for governor of Michigan. Because the voters blame the Dem gov for our economic woes, a Repub will be our next governor. I hope Hoekstra doesn't get the nomination. We don't need a righty running the state. They care way too much about business, busting up the unions, and pushing their social conservative agenda. Many of our current problems go back to the last Repub gov (Engler).

Then again, anybody with a dog in this fight and something to lose in an election (ie, they have a pulse) has two choices: get informed and get their butts out to vote or letting others make those choices for them. Perhaps if Hoekstra was familiar with some of our country's basic documents, e.g., the Declaration of Independence, then he wouldn't be constantly surprised at how our government works when his party is not in charge.

One point that seems to be missed is so what if he was read his Miranda rights? All they do is allow any statements he makes to be used in a civilian trial, basically keeping the civilian route open. They don't guarantee him anything; not even a civilian trial.
If Holder changes his mind and later decides to use a military tribunal, the fact that this guy was Mirandized wouldn't mean anything. They can still ship him down to Gitmo and waterboard him 83 times, and then the rules evidence in whichever court process they use would apply. This Miranda stuff is, of course, all simply nonsense... but I don't think anyone here doubted that.

They aren't Miranda rights, people, and they don't exist or not based on being read the warning authorized in Miranda. Rather, a duty arises at the time of taking someone into custody for the arresting agent to advise the arrested person of certain rights they have if we ever want to use the result of questioning in court. The big 2 are that you can shut up and ask for a lawyer, but those rights exist under the 5th and 6th Amendments whether you get told about them or not.
Of course, since Hoekstra's a moron who doesn't give a crap about trying this guy, he can't be expected to understand little issues like basic criminal procedure. But for everyone else, please understand that the magic Miranda warning didn't give him the right to ask for counsel - the Constitution did, and if the bomber had ever seen an episode of Law & Order he'd know what to ask for.

Look, If the FBI or any law enforcement HAD NOT read Timothy McVeigh his rights, that would have raised a preliminary issue at trial and while I don’t think he would have gotten off on that basis, law enforcement likes to follow the rules at least pro forma, so that they don’t get their cases thrown out.
It’s not being nice to the criminal at all – it’s making sure the frakking conviction sticks because the arrest was good and the subsequent evidence can come in at trial.
It’s not about coddling criminals or terrorist – IT’S ABOUT CONVICTING THEM AND MAKING IT STICK.

A. After a person has officially been taken into custody (detained by police) (AND CHRISTMAS BOMBER WAS IN CUSTODY AT THIS TIME), but before any interrogation takes place, police must inform them of their right to remain silent and to have an attorney present during questioning. A person is considered to be "in custody" anytime they are placed in an environment in which they do not believe they are free to leave. Example: Police can question witnesses at crime scenes without reading them their Miranda rights, and should a witness implicate themselves in the crime during that questioning, their statements could be used against them later in court.
